New Program Creating Mandatory DNA Collection for Certain Crimes

The Executive Budget proposes expanding the number of DNA samples collected and also specifies which officials are responsible for sample collection. Article VII language creates a statewide process that requires courts to order offenders to a sheriffs’ office for the collection of DNA samples. In the case of offenders sentenced to probation, including a sentence of probation imposed in conjunction with imprisonment, when a sample has not already been taken, DNA samples are to be collected by the probation department supervising the designated offender.
